GENERAL TERMS AND CONDITIONS OF THE YACHT CHARTER AGREEMENT (GTC)

§ 1. General Provisions and Parties to the Agreement
These GTC set out the terms and conditions governing the rental of yachts (charter) through the Agency, acting in the name and on behalf of the Yacht Operator.
The charter agreement is concluded between the Yacht Operator (the owner or authorised operator of the yacht) and the Charterer.
The Intermediary (Agency) participates in the conclusion of the agreement by facilitating communication, administrative formalities and payments, but is not the party responsible for providing the yacht charter service.

§ 2. Payments and Cancellation Terms
Unless otherwise specified in the Booking Confirmation, the Charterer is required to pay the charter fee as follows:
a) First instalment: 50% of the total charter price, payable by the deadline specified in the Booking Confirmation (usually on the date of booking).
b) Second instalment: the remaining 50% of the charter price, payable no later than by the deadline specified in the Booking Confirmation.
Payments must be made by bank transfer to the bank account indicated in the Booking Confirmation.
The Charterer is required to provide the Crew List no later than 30 days before the commencement of the charter.
If payment is not made by the applicable deadline, the Yacht Operator is entitled to withdraw from the agreement. Any advance payments already made are non-refundable.
In the event of cancellation, the Charterer must immediately notify the Yacht Operator and/or the Agent. The purchase of cancellation insurance is recommended.

§ 3. Handover and Return of the Yacht
The charter price includes the use of a fully operational and clean yacht, complete with all required equipment and with full fuel and fresh-water tanks.
Embarkation (check-in) takes place from 5:00 p.m. on the first day of the charter, unless otherwise specified in the Booking Confirmation.
Disembarkation (check-out) must be completed by 9:00 a.m. on the final day of the charter, unless otherwise specified in the Booking Confirmation.
The yacht must return to its home port, or another port specified in the agreement, no later than 5:00 p.m. on the day before the end of the charter so that the underwater section of the hull can be inspected by a diver. In the event of a delay, the Charterer will be charged the cost of arranging an additional diver inspection.
The yacht must be returned in no worse condition than at the time of handover, allowing for normal wear and tear, and with a full fuel tank.

§ 4. Security Deposit
Before the yacht is handed over, the Charterer must provide a security deposit in the amount specified in the Booking Confirmation, depending on the class of yacht.
The security deposit secures the Yacht Operator’s claims arising from damage, missing equipment or failure to comply with the terms of the agreement, including failure to refill the fuel tank.
The security deposit will be refunded, or the pre-authorisation on the payment card released, promptly after the end of the charter, provided that the yacht is returned on time, without damage and with no missing equipment.
Hiring a skipper does not release the Charterer from the obligation to provide the security deposit.

§ 5. Liability of the Yacht Operator
The Yacht Operator is liable only for damage resulting from its gross negligence.
If the designated yacht becomes unavailable due to a breakdown, the Yacht Operator is entitled to provide a replacement yacht with similar specifications. The provision of such a replacement yacht does not constitute grounds for any claims.

§ 6. Obligations of the Charterer
The Charterer, or the designated skipper, must hold the appropriate licences and possess sufficient experience. The Yacht Operator may refuse to hand over the yacht if it considers the crew’s qualifications or skills insufficient.
The Charterer undertakes to:
Comply with the laws of the country in which the yacht is operated and with the principles of good seamanship.
Not use the yacht for commercial purposes, racing without prior consent, or the transportation of hazardous materials.
Not leave the port when the wind force exceeds 7 on the Beaufort scale.
Check the oil and fluid levels and the condition of the bilge daily.
Immediately inform the Yacht Operator of any breakdowns, damage or collisions.
Obtain the Yacht Operator’s prior approval for any repairs costing more than €75.

§ 7. Liability of the Agent (Intermediary)
The Agent (Intermediary) is liable only for errors arising directly from the provision of intermediary services, such as the incorrect transmission of information or booking errors.
The Agent is not liable for the technical condition of the yacht, the course of the voyage or the Yacht Operator’s failure to perform its obligations under the charter agreement.

§ 8. Final Provisions
Signing the inventory list upon handover of the yacht constitutes confirmation that the yacht is in good technical condition.
Any matters not covered by these GTC are governed by the provisions of the Civil Code and the law applicable in the country in which the Yacht Operator is registered.
The full charter fee remains payable to the Yacht Operator regardless of whether the Charterer uses the entire charter period specified in the agreement, including where the yacht is returned early by the Charterer.

I used consistent contractual terminology throughout, including Yacht Operator, Charterer, Agent, Booking Confirmation and security deposit. Because this is a legally binding text, the final English version should be reviewed by a lawyer familiar with the governing law before publication or use in contracts.
